1992 Protocol (London) to
the International Convention on Civil Liability for Oil Pollution Damage
Limitation is not available where the damage resulted
from the owner's personal act or omission, committed with intent to
cause such damage, or recklessly and with knowledge that such damage
would probably result.
The limits are 3,000,000 SDR for a ship not exceeding
5,000 units of tonnage, and for ships in excess thereof, an additional
420 SDR for each unit of tonnage in excess, up to an aggregate of 59,700,000
SDR. The ship's tonnage, for limitation purposes, is the gross tonnage
(in accordance with the 1969 Convention on Tonnage Measurement).
